Many of the people in the PEO Industry still think PACE is something you dip your chips in. 

PACE, is the acronym for “Professional Administrative Co-Employers, PACE is one of the PEO Industries associations.  The association is considerably smaller than NAPEO (National Association of Professional Employer Organizations), but the meetings are always interesting and informative.

The title may seem to the point, but everyone in the PEO Industry has had someone who is confused by what a Professional Employer Organization is.

Most PEO professionals have gone through the effort of introducing the concept of PEO to a prospective business client, only to have them say; oh, my Insurance person does that for me, or my Accountant handles that for me. 

But they don’t, they can’t do what a PEO can do for the business.

Sure a business may outsource one or many of the offerings that a PEO handles for them.  Several businesses outsource their Human Resources, Workers Compensation, Benefits, or Payroll.  But just because one or more of the core services that a PEO offers is outsourced, a business owner can’t compare outsourcing to the benefits of having a quality PEO to help manage their employment process.

Co-employment makes the difference, in a PEO relationship, the PEO becomes a co-employer with the business and the PEO is the employer of record for tax purposes.

Every day I have someone ask me something about Health Care Reform.  At first I tried to address the question or concern, and then it hit me.  I have the answer, so now I simply look at them and say, you need a PEO for your company.

It’s day 1 at the PACE Professional Employer Conference in beautiful San Antonio Texas.

I was lucky enough to arrive a few days early and was able to enjoy the wrap up of San Antonio’s Fiesta, San Antonio is such a great city with so much to see and do.

The annual “PACE” conferences are always a favorite association meeting, this year has record attendance and kicked off with a presentation by John Slavic of Slavic401k.com, John’s presentation 5 Major Trends that are driving the U.S. Economy.  John’s interpretation of the economy and how it impacts the Professional Employer Organization Industry are always insightful.  Slavic 401k has invested a lot in creating what they call the “PEO Employment Index”. The PEO Employment Index shows a trend that employers who use a PEO tend to have more growth than those that don’t.

Next up, a discussion regarding PEO Workers Compensation with representatives from Risk Transfer, Lumberman’s, Sunz Insurance Company and Tower Group.  A great panel discussion regarding best practices, workers compensation industry changes, and what changes PEO’s can expect over the next year.

Even lunch was entertaining and informative with a bit of history about the PEO Industry, followed up with a presentation by Tom Jackson on the History of the Alamo.

Hawaii did it - Michigan should be next | PEO Blog

Not sure if you had heard, but on July 10th Hawaii’s Governor VETOED their Senate Bill 2424, which could have put a number of the PEO’s in Hawaii out of business. 

This is an example of how the creation of necessary government could have crippled the entire PEO industry in Hawaii, leaving only a couple large PEO’s to do business in the state.

Our industry does not need state regulations, we are already heavily regulated by existing employment, insurance, and other laws, both federal and state, and the Michigan Professional Employer Regulatory Act creates an additional layer of unnecessary oversight and expense.  An unnecessary expense to the PEO’s, the State of Michigan and PEO Clients in Michigan.

Michigan PEO Licensing Law – Repeal or Deregulate | PEO Blog

There is an effort being put forward in Michigan to repeal the PEO licensure and regulations imposed on PEO’s known as 2009 Senate Bill 1037 – 2010 PA 370.  Michigan’s Office of Regulatory Reinvention has listed Professional Employer Organizations as one of the Occupational Licensing area to de-regulate.  In addition on May 29th, 2012 Michigan’s Rep Jeff Farmington presented House Bill 5686 to repeal the “Michigan Professional Employer Organization Regulatory Act,” 

This legislation was pushed through by one of the industry associations who appear to support the needs of the larger national PEO’s over the local or regional PEO’s.  As members of the PEO industry a number of us believe we should all have a voice in what happens to our industry.

So we are launching a campaign to make our representatives and government leaders aware that as an industry we are in favor of less regulation, less red tape, so we can continue to grow our industry in Michigan and throughout the country.

While attending the 2012 Franchise Expo South at the Miami Convention Center, I was amazed to see all the new and exciting franchise opportunities that were present this year. Every aisle featured a wide array of franchise enterprises offering almost every category of business and consumer products and services. The Expo represented a who’s who of the franchise industry.

Exhibitors included well known veteran operators like Baskin-Robbins Ice Cream and Sign-A-Rama, as well as two new entrants from Palm Beach County, FL. The Original Brooklyn Water Bagel Company and Hurricane Grill and Wings, were rolling out fresh new restaurant concepts with delicious and original menu items that are sure to please the entire family.

A variety of personal service concepts were on hand, from accounting and financial services to health care, home care, and personal security, to beauty services and spas. There was one common theme throughout—the franchise industry was alive and well despite a weak economy and tight credit environment.

Some people have been heard saying they “like being able to fire people”, next week some of those same people may be heard saying they like to start people on fire…. who knows why people say what they say.

Seriously, does anyone really “LIKE” to fire people?  I mean, nobody could really “LIKE” to fire people could they… well I’m sure there are a few individuals that truly do like to fire people, but my belief is that the majority of us would just prefer, and wish people provide the level of service that we expect, that way we’re happy and the individual can stay employed a while longer.

A quality PEO can act as a sounding board for its clients; a good Professional Employer Organization can provide insight on how to hire right.  If you hire right, and have employee issues, talk to the HR professionals at your PEO, they can help with your procedure’s to address any employment issues as they arise, making sure proper documentation is in place.  If it becomes necessary to fire an employee, once again you can lean on the experts at your PEO to make sure you don’t violate laws and that the termination is handled properly.

I’m back… and I’m excited about 2012.

So I took a short sabbatical over the holidays, I hope everyone had a fabulous Holiday Season, I certainly did…  but I’m back and I’m more committed than I’ve ever been to building recognition of the PEO – Professional Employer Organization Industry.

The conversations I’ve had with others in the industry would indicate that we are positioned for a banner year.

So I’m keeping today’s blog short and simple… take 5 minutes to think about what you’re thankful for… personally, my family, my friends, my faith, my business… well, I need more than 5 minutes.  But once you’ve thought about it, call – text – poke – email – tweet - tag a couple people that are special to you and let them know you are thankful for their friendship – you’ll make their day and yours.

So anyway, it’s really funny that in one week I’ve had two of the questions that make me laugh come up.  Yesterday’s blog was addressed the question, “Why doesn’t everyone use a PEO?”  So yesterday I started participating in a business owner’s roundtable where we discuss issues that relate to business issues from an ownership perspective. 

So we start going around doing our introductions and after I did my introduction and then went into an explanation of what a Professional Employer Organization does, the individual next to me looks at me and says “Where have you been?”  I need you to help me…. So if you read yesterday’s PEO Blog you know I typically name situations.  I looked at the individual and said, you’re a 10 percenter! 

That’s right, a 10 percenter!  What’s a 10 percenter you ask?  About 10% of the population will get it, they understand the concept immediately and grasp how a PEO can help their business in regards to Human Resources, Workers Compensation, Benefits, Payroll and more – those individuals are 10 percenters.

I love 10 percenters, they are what keeps me going, they totally understand that their attention should be given to running their business and not dealing with the employment side of business.  In this particular case the individuals business suffered from the distraction, plus their personal life was taking a hit. 

PEO’s, and the entire concept of Human Resource Outsourcing can give the business owner some long sought after freedom… freedom to run their business, while the PEO does its job.

Why doesn’t everyone use a PEO?  Every time someone asks me that question it makes me laugh. I’ve gotten to the point where I just say it’s all about the light bulb.

It happened again last week, a new client asked me “Why doesn’t everyone use a PEO – Professional Employer Organization?  I chuckled and said, it’s all about the light bulb.  On the back of my business card I have this message…. “Professional Employer Organizations are simply a better way to manage employment.  If you have employees, we help you consolidate the processes required to manage them… including Human Resources, Workers Compensation, Benefits, Payroll and more.  Our concept shares technology, expertise, and services all while taking advantage of pooled purchasing power.  We create employment practices and benefit offerings designed to attract and retain the best employees.”  That’s it, simple and to the point.

But you either get it, and the light bulb comes on, or you don’t.  It’s not about being bright, or smart, it’s about grasping the concept.  Having been a former business owner, when the concept was explained to me 1991, the light bulb went on, and back then I asked the same question, “Why doesn’t everyone use a PEO?”  I was so excited about the concept I changed careers at the time and became a sales agent for a PEO.  (back then it was referred to as Employee Leasing). 

I was convinced that I would have businesses lining up to take advantage of something that was and still is a brilliant concept for businesses.  I mean, having dealt with the minutia of managing employment, it quite honestly made me crazy…I mean seriously, nobody goes into business to have employees.  What a shocker I had in store for me.  To make a long story short, it’s been a frustrating career choice at times, whenever I see those door to door missionaries I always wave and smile, thinking about how they like me have a message they are trying to communicate, like my message about PEO services, their message is either accepted or rejected… what keeps me going are those clients that totally get it, and prospects that are hanging out there just waiting for me to make their light bulb glow!

Businesses need to be careful how they pay their employees on any day, but particularly so when winter weather is involved. For example, did you know you must pay your exempt employees even if no work is performed on a day the business closes due to bad weather?

Outsourcing human resources to a PEO melts away stress because businesses can trust a PEO to update company policies so that employees know what to do when bad weather strikes, whether it’s a blizzard or a hurricane.

With Old Man Winter bearing down, here are a few workplace scenarios that should be on all business owners’ radars:

• Company closes due to inclement weather (or any other reason for that matter)

If a company closes and its employees are otherwise willing and available for work, exempt employees must be paid for the time. The Fair Labor Standards Act (FLSA) dictates that these employees are guaranteed a salary, and no docking is allowed, unless the closure is in one-week increments and no work was performed for the employer.

Employers should also be cautioned against deducting from a paid time off (PTO) bank in instances of company closures. Non-exempt (hourly) employees do not have to be paid for the time not worked. Employers have much more flexibility with non-exempt hourly employees – if they don’t work, they don’t get paid. 

• Company does not close, but inclement weather forces some employees to stay home

If a company remains open but some of its exempt employees claim that they cannot or are not willing to brave the weather, employers should be cautious how they are treated. Generally speaking, these exempt employees are entitled to their wages for the day; although, personal, vacation or PTO time can be reduced commensurate with the time missed.

If that exempt employee is out of PTO, personal, or vacation time, this is one of the few circumstances where their pay can be docked – but only in one-day increments, and only if no work is performed by the employer. This gets tricky in the age of remote connections and mobile devices.  The best practice in this circumstance is to pay, so as not to risk violating the FLSA.

Non-exempt employees once again do not have to be paid as long as no work is performed – regardless of whether it was the employee or employer who “called off”. Best practice is to reduce a PTO bank for these voluntary absences.

• How do businesses deal with this proactively?

Having an inclement weather policy can certainly help, which is where a PEO can be invaluable. (Remember that melting away of stress?) When a winter storm looms, employees spend a lot of time and energy trying to figure out when they can go home, and if they will be paid if they can or cannot come to work. Having a proactive policy that addresses time off in these situations can be very helpful.

Additionally, if an overnight storm is approaching, it is a good practice to set up a spare voicemail that employees can call periodically for up-to-date information on closures and other instructions.

Mother Nature has her own mind, and every business is susceptible to shutting down temporarily, or employees might be forced to stay home on occasion. Having an airtight policy in place and being proactive will go a long way in battling any storm brewing on the horizon.

Why doesn’t everyone know what a PEO is?  What’s the confusion, what can Professional Employer Organizations do to help clarify and promote the PEO Industry?

Early this year we set out on a mission to help promote the PEO – Professional Employer Organization Industry.  If you’ve read some of my earlier blogs we’ve discussed the issue of why hasn’t the PEO Industry managed to grow more than it has?  I mean, the concept is brilliant, if you are a small to medium sized business you need to find a quality PEO to manage your Human Resources, Workers Compensation, Benefits, Payroll and more. 

The bottom line is… there isn’t a small to medium sized business that couldn’t benefit from finding and using the services of a quality PEO.  So with that being said, why hasn’t the PEO Industry been able to grow past a market penetration hovering around 3%?

There are a number a reasons, and a number of solutions.  Over the next several weeks we’re going to touch on issues, and solutions… this is blog and I only have so much time daily to spend typing, but we will identify issues, and develop solutions.

Certainly I can’t be the only person wondering why the industry hasn’t grown more.  (although I often feel that way)  And I am committed to do whatever I can to promote and educate as many businesses as I can about the PEO Industry.

I got an email yesterday from Rob Blunt, Rob’s a consultant to the Professional Employer Organization (PEO) Industry.  Rob’s roots go back to selling PEO services for Administaff back in the early stages of the industry, Rob’s company is called PEO Consulting Group Inc.  For the past several years he has been working as a consultant to PEO’s, HRO’s, and ASO’s, developing concepts and tools to promote the entire concept of Human Resource Outsourcing.

So anyway, Rob is extremely analytical, just listening to him talk numbers and statistics makes my head spin, but I love the way he approaches the PEO sale, and I would contribute a few of my sales to what I have learnt from Rob.

Human resource outsourcing and professional employer organizations provide SMEs, small and mid-size companies with a wide range of valuable administrative, professional, and technical services, whose functions can be burdensome, and disruptive to an organization, if not handled appropriately. In the course of our evaluation process, we examine all of the important functions that a company transfers to the professional employer or employee leasing company. We will look closely into their payroll application and HRIS human resource information system. Usually we arrange a demonstration, so that HR managers and payroll administrators can test a program’s ease of use, flexibility, and experience the power of the HR platform first hand.

A a PEO consultant we evaluate and compare each PEO’s employee benefits plans, examining group health plans, dental and disability coverage, and 401k retirement plans. When workers compensation is a challenge, we’ll call for an on-site risk assessment, and go over loss prevention programs, risk avoidance and management systems, as well as OSHA reporting. Usually during the process, a business owner or HR executive will ask “With all of the critical factors we use to evaluate a professional employer organization, which is the most important factor to consider? The answer for me is a simple one.

PEO Market Penetration - 3% May be to High | PEO Blog

It is generally accepted that Professional Employer Organization - PEO market share is 3%.  Now we also hear the number 3 to 5% now and again, but that seems like a little bit of fudging.

Perhaps we should look at the actual number using census bureau data.  As of 2008 there were 2,203,513 companies that had employee counts from 5 to 99. I think most would agree that this covers the average size of a PEO client business.

Now if we took 3% of that total we would have 66,105.  Most have reported that PEO currently services 50,000 businesses, so what’s happened to the other 16,105? Oddly that can be answered by using a more realistic number on the “average size of a PEO client company” – that number is 14. That knocks out 526,307 businesses.  1,677,206 is a more real number.  Now we get 50,316.18.

I personally have tried to justify the low market penetration by saying that there are a lot more businesses now than there used to be, so it would be 3% of a lot larger number. The truth is that is only somewhat true, but not by a huge number.

As an example here is the census bureau data on number of companies with employees numbering 5 – 99:

• 2008 = 2,203,513 businesses                  
• 2001 = 2,153,427 businesses
• 1998 = 2,106,373 businesses

We are growing for sure, but the net increase in ten years is a scant 97,140 businesses.

SO WHAT’S THE ANSWER?

I decided that the number one problem with PEO was the lack of great closing ratio percentage. We simply were not closing enough of the companies that we did see.  This sends PEO companies into panic mode to “see more prospects” – This can work, short term.

My solution was to come up with a very modern, killer presentation that addressed newly empowered markets that had been created by the Internet.  These empowered markets could easily Google PEO, and they read books on sales.  This meant they knew about the PEO industry, and they had our sales playbook.

What I called a normal presentation is features, benefits and incentives, and it can be taught rather easily.  I saw this at Administaff/Insperity, where for a long time product knowledge tried to; pass itself off as sales technology.  Finally, John Orth, and others stepped in and had an actual sales class. Our turnover of sales people, however, was atrocious in that first 18 months.  When I worked with the sales people that could not seem to get a sale they had a handle on the FBI (Feature, Benefit, Incentive) components, and they were congenial enough, so what was the problem?

The central problem is that it was the buyer.  They had changed and we were not addressing the changes. In other words, we had missed a paradigm shift in the buyer. A lot of trial and error led to two, and only two (major) sales problems. When those problems were corrected closing ratios went from a low of 5% to over 25%. Peak performance PEO sales people did a lot better than that.

The two problems were:
1. Inability to get appointments
2. Lack of a newer type of presentation that addressed real issues that increased the close ratio

What is a PEO? 

I have decided that I need push everyone in the Professional Employer Organization to started talking about the term PEO as it is defined by our industry.  And I will do this until we grow from the 3% market penetration we’ve been at for several years. 

Wikipedia has the following definition;  A professional employer organization (PEO) is a single source provider of integrated services which enable business owners to cost-effectively outsource the management of human resources, employee benefits, payroll and workers’ compensation and other strategic services, such as recruiting, risk/safety management, and training and development.  It does this by hiring a client company’s employees, thus becoming their employer of record for tax purposes and insurance purposes.  This practice is known as co-employment. 

Well that’s a good start, and over the next several months we will get into additional definitions and explanation’s – but back to my point. 

As an industry, Professional Employer Organizations are NOT TALKING ENOUGH.  Every PEO in the country (its estimated that there could be as many as 700 PEO’s in the United States) needs to be writing blogs, using social media like LinkedIn, Twitter and Facebook to get the word out.

The PEO concept is brilliant, if you are a small business you need to be using the services of a quality PEO.  As a business owner utilizing a PEO sets you FREE; you gain Freedom to focus on your business and not on day to day employment issues.

Different PEO’s are different! | PEO Blog

I would guess most of you are asking, what’s with the title “Different PEO’s are different”?  It’s a relatively simple statement – and yeah most everyone that’s part of the PEO Industry knows exactly what I mean, but a lot of prospects don’t have a clue, so my point is PEO’s are different.  I have a good friend of mine that’s a consultant in the PEO – Professional Employer Organization Industry that always says; when you’ve seen one PEO you’ve seen one PEO, she is 100% correct.

So what’s my point, why is this worth even publishing in a blog?  My point is, that PEO’s vary greatly, if you are a prospect looking for a PEO don’t think because you’ve used one PEO, that every other PEO is going to offer the same services that the PEO you’ve used offers.  Don’t assume that if you heard one PEO sales person mention a service that it automatically will be part of every other PEO’s offering.

The basic offerings a PEO has are generally similar and include various elements of Human Resources, Worker Compensation, Benefits, and Payroll.  But when you look at the services delivered they can vary greatly.

Let’s use Payroll as an example; depending on the PEO you choose, some may offer access to your employees so they can view their paystubs, view and change deductions, get copies of previous years W-2’s.  But don’t take this for granted, not all PEO’s have online access for your employees, silly but true.

If you are considering using the services of a PEO, and you are comparing a two or more PEO’s make sure you are aware of the services each PEO offers, don’t take it for granted that all the service levels are the same.

The Four P’s of HRO and PEO Evaluation | PEO Blog

All too often companies spend hours analyzing, assessing, and comparing the cost or savings that one HRO (Human Resource Outsourcing) or PEO (Professional Employer Organization) service provider offers versus another. While a detailed spreadsheet of costs may help to determine “hard dollar” expenditures, it very rarely accounts for the intrinsic value of the competing service models which is what HR directors and management is trying to compare.

When working with executives and consultants, very often items such as the co-pays of a health plan, workers compensation rates and administrative fees take precedence over far more important questions.  Are you teaming up with an outsourcing partner who is flexible enough to meet your demands? Will you have to conform to “their” way, and if so, when and how often? Is their expertise, services and strengths complimentary or duplicative? Is your corporate philosophy compatible? Only by completing a thorough investigation can busy executives be assured of making the “right” choice.

Focusing in on these 4 P’s will help to guide you through the process.

People – Meet with the management and team you will be working with in person, by phone or teleconference. What are their backgrounds, functions, qualifications, and responsibilities? What are the scopes of services each will deliver, how, and how often?

Process – What is the plan for a smooth transition? Map steps for employee notification, orientation, and enrollment. Identify all the who’s, what, where, and when of plan implementation. Establish clearly defined goals, time-lines, reviews and evaluations.

Platform – Human Resource Information System (HRIS) provide a robust set of tools for employee administration, benefits, compliance, payroll, and risk management. Identify levels of employee and management access, orientation, and training. How will you coordinate IT staff for system integration with automated attendance and Point Of Sale systems, 3rd party software and hardware?

Programs – Employee Benefit programs provide a competitive edge in attracting and retaining a highly motivated and productive workforce. Evaluate the quality, value, and choices of health, life, dental, disability and retirement plans. What employee communication, mediation, recognition, rewards, and relocation services are available?

Human Resource Outsourcing (HRO) and Professional Employer Organizations (PEO) are proven to help improve service and manage operating costs and cash flow. So it’s not astonishing, given the grimness of our current economic situation that companies are increasing their use of outsourcing to cut costs in many areas, to include HR.

HR outsourcing offers key benefits, including reducing costs, increasing the potency of HR delivery, providing greater expertise, and moving HR up the value chain to aid in organizational growth. The motivations for outsourcing Human Resources are access to skills and knowledge, quality and cost reduction.

The past fifteen years have seen an unprecedented rise in employee to employer litigation, employment regulations and tax laws. Effective management of Human Resources has become a complex task for small to mid-market business owners. Then, there is the laundry list of unfriendly policies, including laws governing hiring, family leave, sexual harassment, paying employees, leaves of absence, employee benefits, and workers’ compensation, not to mention the new healthcare laws coming.

Companies also want to use one human resources vendor. They consider it easier to manage, and they know they can get a better deal by adding volume to the vendor relationship. Even if the HR outsourcing company contracts out some aspect of their outsourcing agreement, the client still has only one vender to deal with. As Robert H. Brown of Gartner says companies like the idea that of anything goes wrong, they have “one throat to choke.”

According to a survey by Hewitt Associates employers seem to feel that this single vendor approach also leads to less employee confusion, better integration and easier coordination of services, as well as less time dedicated to vendor management. Analysts say that employers start out by focusing on business metrics like productivity, profitability and employee satisfaction, but in the final analysis savings seems to drive about half of the companies into HR outsourcing, while the other half don’t rate savings as the main motivator.

The additional motivators employers gave for HR outsourcing were:

Gaining outside expertise, improving service quality, and the ability to focus on their core business.

Employee-related litigation is a constant worry for any employer.

U.S. Equal Employment Opportunity Commission (EEOC) charges reached an all-time high in 2010; wage and hour complaints constantly threaten a company’s bottom line.

Responding to an EEOC charge – many of which are frivolous – can cost a small company thousands of dollars – and that’s before it even reaches the formal stage. Legal fees can skyrocket when defending against a wage and hour complaint in court.

Staying up to date on labor laws is critical to the success of small- and medium-sized businesses, many of which lack the resources to do so on their own. That’s where a Professional Employer Organization (PEO) comes in: Part of a PEO’s responsibility is to stay educated on workplace laws and regulations and develop and maintain legally-approved workplace policies, both of which provide an employer peace of mind when it comes to employee-related litigation.

In 2010, a record 99,992 charges were made to the EEOC, a seven percent increase over 2009. A stale economy could be to blame, as those terminated from jobs might be lacking the financial resources to fall back on than in the past, spurring attempts to recoup lost paychecks.

Case in point: The dynamic of charges has changed. Retaliation is on the rise. In 2010, 36.3 percent were retaliation charges, marking the second year in a row it led all categories.

Simply responding to an EEOC charge can cost an employer a minimum of $3,000 and can quickly climb to as much as $8,000. If the EEOC awards the employee the right to sue and the worker follows through, defending against a charge can be catastrophically costly.

The nature of retaliation charges also has evolved over time. For the first time, the National Labor Relations Board (NLRB) is targeting non-union employers because of some provisions of the NLRB Labor Code, namely the guidelines surrounding concerted protected activity.

Social media has played a key role in retaliation charges rooted in concerted protected activity. Consider this scenario: A few employees are disciplined for something and then tweet or post a facebook entry about the discipline. If the employers are then fired, they could have a legitimate retaliation charge because their conversation is protected under concerted protected activity.

A renewed investigatory focus by federal agencies also could be fueling an up tick in retaliation charges. Agencies such as the U.S. Department of Labor and the EEOC have increased personnel as more funding is available for enforcement. For example, the budget for OSHA’s whistleblower protection program will increase $6 million in 2012, giving renewed focus to the activity.

It’s no wonder that employers can feel overwhelmed in safeguarding against litigation.

A PEO’s role is to train and educate about issues that could lead to such court cases. A small- or medium-sized company lacks the resources of a PEO, such as being internally knowledgeable of labor laws or to research such issues. Doing so could lead to paying a retainer to a defense attorney or paying $400 an hour to have an outside firm conduct critical training.

Additionally, A PEO offers training on a regular basis and can respond quickly to employer-related questions. A PEO offers defense services and employment practices liability insurance. All are proactive solutions, rather than reactively forking over thousands for representation, and allow an employer to focus on his core product and the health of his company.

An employer can stay ahead of employee-related litigation with a few easy steps:

• Policy development: Have good policies in place, including one addressing social media participation (every social media policy should mention the terms of the policy are not intended to interfere with concerted protected activity), and regularly update employee handbooks.
• Ongoing informal education: Guide your employees to changes in federal labor laws.
• Formal training: Ensure that your employees are well versed in company policies and federal guidelines, such as sexual harassment.

Costs associated with employee-related litigation can destroy an otherwise healthy business. By staying in front of workplace issues, an employer can enjoy a productive environment and gain the trust of his most valuable resource – his employees.

I’ve been following a LinkedIn discussion regarding Professional Employer Organization – PEO services provided by a Minority Certified PEO.

It’s been interesting following the discussion; surprisingly a number of people wondered what constituted a Minority Certified Company in general so I thought it would be helpful to explain it.

When to Hire a HR Manager?  NEVER! | PEO Blog

I ran across a great Blog on TribeHR.com titled Human Resource Problems: When to hire an HR Manager click the link to read it over. 

The article makes a very good point with its opening statement “When you have more staffing issues than you’re capable of dealing with, it can really hurt your organization’s bottom line” and then it follows up with “But don’t worry—HR can Help!”

But the solution isn’t HR, the solution is having a quality Professional Employer Organization – PEO manage your employee administration. 

And the GREAT NEWS is that you don’t have to wait to have quality HR solutions in place.  I know several of the large national PEO have a minimum requirement based on the number of employee’s, but there are several regional PEO’s that will take you when you are small, and they’ll grow with you.

Now what I love about the blog is, they hit on some things that startup and growing business lose focus on, is that no HR or bad HR can torpedo the growth of your organization.  Nobody needs the distractions or drama that can be caused by employee’s gone awry. 

Another interesting fact is their recommendation of approximately 1 HR rep for every 50 to 55 employee’s – I would agree with that.  But I don’t think the best solution is bringing HR inside of the company.  The better solution is to find a quality PEO in your area, with a PEO you get a team of experts, you typically share the cost of expensive technology, and you can access better benefits which will allow you to grow your business without the distractions of managing employment.

Can the Post Office be saved? | PEO Blog

Later this month, my local Post Office will be closing.

It’s been an interesting adventure to see our community go through the process of trying to save the local post office, and I think the bigger question is “Can the Post Office be Saved”?
Some of you are asking, what does this have to do with Professional Employer Organization – PEO Services… and my response would be it’s all about change.

Our community was in an uproar, after all our local post office wasn’t on the official list of post offices scheduled to be closed.  The lease on our post office just happen to be expiring, and with all the closings scheduled it was just easy for them to add ours to the list.  It has been a bit frustrating, I have a PO Box at the local post office since carrier delivery just isn’t consistent with the harsh winters, and now I’ll need to find another alternative.

The community rallied, Senator and Congressmen were sent letters to save our post office, we had a town meeting with the post office officials, and that’s when I realized, without massive changes the post office is destine to fail.

Now I’m not blaming the postal service for everything, but they need to change… and it may be too late.

Now to my message as it relates to our prospects, when we find someone who would be a perfect fit for the Human Resource Outsourcing that PEO’s offer, and yet they just don’t take advantage of the offer it can be real frustrating.

We’ve all heard it, and whenever I hear a prospect say “we’re just not ready for a change in how we manage employment” I do I wonder what I missed in communicating the message.  The post office is a classic example of how business changes, in today’s economy it’s constantly changing, changes are coming faster than ever and it’s important to say focused on everything that impacts your business.

Now that I’ve got attention I’d like to share some stats and my thoughts on why the business community should consider using a PEO.

Why is the Professional Employer Organization (PEO) a $51 billion industry?
Why are there are over 700 PEOs working in all 50 states?
Why have 50,000+ small and mid-sized business organizations bought into the PEO concept?

Are the business owners who are players just not bright? 

ARE THEY WASTING THEIR MONEY?

All PEOs have the task of selling to the small and medium business market. They sell to small business owners, a turnkey system of human resources that includes:

• Payroll + Job Costing +
• Worker’s Compensation +
• OSHA Regulation +
• Benefits + Ancillary Benefits
• Human Resources +
• Regulatory Compliance

PEOs contractually assume substantial employer rights, responsibilities, and risk through the establishment and maintenance of an employer relationship with the workers assigned to its clients. Simply stated PEOs mitigate a company’s risk.

When you start looking at the reasons a PEO could be bad for a business the list ends up being very short.

On most surveys, you find three main reasons that people list as potential hazards.

1. Loss of loyalty from employees = everyone entering into a PEO arrangement has this same concern – the answer is that PEOs are the co-employer of record for administrative purposes only. You are still the boss.

2. Loss of control of major issues that could face my company = the fear may exist, but fortunately, this objection is not reality. The only control question is one regarding gain. You have gained control of your costs and found someone else to do the paperwork, and you will spend more time with your employees because of it.
Furthermore, the client companies agreement gives them the right to terminate services. The client company is the boss.” A PEO relationship allows them to gain more control.

3. Cost = there is mass confusion in this area.  The reason for the confusion is very simple.  Entrepreneurial schools, business schools and most other schools don’t train people in this area.  Literally, it is left out of the general-education curriculum for business people. I had to go to Ernst & Young to get an answer.  The answer is “payroll burden.”  Payroll Burden is ALL those things you spend on, or in support of employees that contributes to overall costs.  Why is this important?  Business people do not know what they are spending now. In the face of this, they use hard costs as a number, or they use hard cost plus SBA numbers (which is better), but the fact remains – they do not actually know the magic number.  As a result when a PEO consultant says 17% or 21% or whatever, there is no data of comparable magnitude. This means the cost can SEEM high. 

The answer is cost analyses, which some companies now have that help the business owner see exactly what they are spending, so that they have a comparison. It should be stated that PEOs take the variable cost of having employees, and make it a “fixed cost” – how does one measure the importance of that?

When you look at a PEO’s ability to deliver:

• Regulatory compliance,
• Payroll,
• 401(k),
• Medical plans,
• Plans administration,
• Dental,
• Vision,
• Human resource consulting,
• Better cash flow,
• Predictability of employee costs,
• Mitigate risk,
And the list goes on…

There is not a bigger bargain on the planet. Plus, the client and her/his staffs are now focused on their core competencies in driving more dollars to the bottom line.

Finally, there is also the fact that a normal small business cannot begin to afford the type of personnel that a PEO has.  When you look at the talent pool within PEO’s it is staggering.  The benefits experts, human-resource experts, legal experts, payroll experts, tax and compliance experts and safety experts could make you drool in envy.

While You Were Out | PEO Blog

I’m laughing to myself, thinking that a big share of my readers won’t know what a “While You Were Out” message was ever used for, for those individuals let’s just refer to them as “Paper Voicemail”.  Back in the old days prior to voicemail and email, and when people still used the telephone as a business communication tool, when you didn’t answer the phone, someone actually took a message for you and wrote it on one of those pink notes. 

Well, today’s message is that have changed since the days when everyone used those “While You Were Out” message pads. 

I love the Professional Employer Organization – PEO Industry, Human Resource Outsourcing has so much to offer the business community, but how do we communicate that message.  Well my sick sense of humor wants me to buy a bunch of the While You Were Out message pads – and fill them out for a bunch of business owners with the following message:  While you were out, the business world has changed.  We have a better solution for managing employment, including HR, Workers Compensation, Benefits, Payroll and more.  Call me so we can connect…Rod

 


I may try that at some level just for fun… but my greater message of the day is we need to all work towards building better messaging about our industry, the PEO Industry has so much to offer, look at how your communicating, in today’s world we’ve replaced those pink message pads with email, instant messaging, LinkedIn, Facebook, Twitter, blogging and more.

It’s All about Building Winning Teams


You may think that this is a bold statement, but the reality is that most entrepreneurs achieve success not because they are visionaries, although many are, but because they are intensely focused on doing what they do best. In an earlier blog “No Man is an Island”, I explain how achieving one’s goal of launching a new concept, product or service requires diverse talents and experience that no single person can master.

Jeff Stibel, author of “Wired for Thought” in his article “Entrepreneurship is a Disease” published in the Harvard Business Review Blog offers this observation “What makes some entrepreneurs successful is the same thing that makes others successful: relying on strengths and avoiding weaknesses”.

 


He continues “To be sure, entrepreneurs have an upper hand (or at least I like to think so): the energy level is higher, the confidence level is higher, and with time, entrepreneurs have a higher tendency to acquire subject-matter expertise. But success comes not from those things alone, but by leveraging core competencies. What makes me successful (sometimes) is that I combine my entrepreneurism with my strengths in taking calculated risks, decision making, and building teams of people I admire.”

So what does this have to do with entrepreneurs and professional employer organizations? Building a great team of dedicated and talented people often requires a structure that involves employees. With the advances in technology, those teams can involve people not only with vastly different backgrounds and skills, but located in different states across the country, or even other countries around the globe. Leveraging Core Competencies

Entrepreneurs and small business owners shouldn’t be expected to know all the intricacies’ involved with employee compensation and payroll tax administration. Don’t expect them to stay abreast of changes in government regulations, employment practices and HR compliance issues. Ok, I am going to try explaining this again.

If you are in the Professional Employer Organization Business (PEO), you need to Blog.
 
Ok, so this is really starting to get a bit frustrating, I personally have met hundreds of people in the PEO Industry, and I know there are thousands of individuals who I would consider Industry Experts, I have opened my door to share the spotlight, give you the mic, so grab the mic and let the work know your thoughts.
 
Maybe this will help you understand how blogging can benefit you - I can pinpoint one blog which in itself created more than $40,000.00 in revenue (year 1).  Without the blog the individual would NOT have had the chance at that opportunity so wake up and grab this opportunity while it lasts.

Here’s the concept, write a blog about the PEO Industry.  It can be on any topic that relates to why businesses should use the services of a PEO.  Maybe a story about one of your customers, maybe something, how you solved a customer problem, how employee’s benefit from a PEO relationship.  There are thousands of people who sell the PEO service, your blog message needs to be what you are talking about to your prospects and clients.

The PEO concept is brilliant; there aren’t many businesses that couldn’t benefit from a relationship with a quality PEO.  Seriously, don’t you have a story…share it and help us grow this industry!  I have been beating this drum for years and will continue to until this industry starts to take off like it should.

We are looking for content that can be used by everyone in the industry, so write the blog about the industry, not specific to your company, you will be given credit for the blog with a short bio about you and your organization, some blogs we’ll create whitepages and once again include credit you for the document.

Well I’d like to thank my friends at the “X” Factor, after spending some time watching the show over the last couple evenings it got me thinking…

Where are the PEO Industries Stars?

What do I mean by PEO Industry Stars – the individuals who have the ability to Educate the Business Community about the PEO Industry.

I do have a secret, I’ve found a few of them… and you’ll find out next week who they are when PEO.com launches it’s “Guest Blogger” program.

But I know there is more talent, more stars – so I’m opening the auditions up NOW!

What’s the purpose… we need help in educating the public on - What a PEO is, How a PEO benefits employers, Advantages of using a PEO, success stories, etc.

It’s an open field, anything you want to blog about that presents the PEO industry in a positive fashion.  Remember our goal is to help educate the general public and also provide tools for the PEO industry to help advance the industry.

PACE’s Response to NAPEO’s‘Small Business Efficiency Act of 2011’ (H.R. 2466)

At a time in our history when it is becoming increasingly obvious how excessive regulation hurts our economy as a whole, and small business in particular – which includes most PEO’s and almost all of their clients – NAPEO is again attempting to pass federal legislation that will add another layer of heavy handed bureaucracy to our already struggling industry. Not everything in this legislation is bad. However, the same onerous provisions are in this bill that were in previous bills sponsored by NAPEO…and these provisions have the potential to make life miserable for all but the largest companies in the PEO industry. And the compliance costs will be exorbitant.

The NAPEO mantra has been that this legislation will create “legal certainty” for our industry and small business clients at the federal level. We at PACE believe this concept of “legal certainty” is unattainable or, at best, is a moving target that will require amendments and additions to this legislation in the future that will only add to the complexity and expense of compliance. Just look at what has happened at the state level where licensing laws have been in place for a while. Has compliance become easier…or less expensive? Has it ensured legal certainty? Or, as is usually the case, have the few positives of any of this well-intended legislation been overshadowed by the negative unintended consequences…not the least of which is placing your fate in the hands of government bureaucrats or some “impartial” licensing board?

Let’s look at some of the specific provisions of this bill (linkhereto see the entire bill).

The couple of positives we see are:

1.One: Treating the PEO and client as the successor employer when they enter/leave the co-employment relationship. This obviously makes it easier for both sides to establish/terminate a co-employment relationship in the middle of a calendar year for tax purposes.

2.Two:Absolving the client of any federal tax liability for federal taxes they have already paid to the PEO. While we have not heard of this being a serious problem for client companies of PEO’s who have not paid their federal tax liabilities (assuming the client did pay the PEO in good faith), we believe this would be positive provision.

Now for the negatives:

IRS certification. This is the essence of the entire bill. It sets out the basic requirements for becoming a certified professional employer organization (CPEO) and places the enforcement of those requirements in the hands of the Secretary of the Treasury and the IRS. It also gives the Secretary (i.e., the IRS bureaucracy) total latitude over establishing the rules and regulations “to carry out the purposes” of this legislation. While touted as “voluntary” certification, a PEO will have a very difficult time competing as a non-certified PEO…so it might as well be mandatory, and probably will be at some point. We know of no other industry in this country that would agree to cede this much control over their existence to the IRS.

Some of the more onerous requirements for certification are:

1·One: Owners, officers and “others” in a PEO must meet requirements “with respect to tax status, background, experience, business location, and financial audits” as specified by the Secretary of the Treasury. In other words, the Secretary can determine if you are allowed to own or establish a PEO.
·
2.Two:A PEO must post a bond of at least 5% of the previous year’s federal tax liability, up to $1,000,000 (at least initially). For those of you already in several states with licensing laws, your bonding capacity is probably already stretched to the max…unless you are one of the very large PEO’s.
·
3.Three: Quarterly financial reviews and annual audits as specified by and to be submitted to the Secretary (i.e., the IRS). Very expensive.
·
4.Four:A PEO must contractually assume responsibility for the payment of wages, taxes, benefits, etc. of all worksite employees “without regard to the receipt or adequacy of payment from the customer”. This is like handing a blank check to an unhappy, unscrupulous or financially stressed customer.

These are just a few of the troubling provisions in this bill. Please read it carefully and let us…and NAPEO…know if you share our concerns. We at PACE believe that responsible federal legislation could be crafted to be benefit of the industry as a whole, and not just a few select companies. H.R. 2466 is not that legislation.

Outsourcing Human Resources can cause alarm in any workplace.

Will jobs be lost? Will the cost of healthcare increase? Will benefits decrease?

All are understandable reactions as the economy continues to tread water and the prospect of becoming unemployed remains an ever-present reality.

A Professional Employer Organization (PEO) – an outside company that handles human resource services – often is seen as an interloper or labeled the enemy because of misconceptions that it will lead to firings of in-house staff or increased costs.

In reality, a PEO works as a company’s partner and presents countless advantages to small- and medium-sized employers, allowing them to focus on their product – and employees – rather than worrying about the latest in healthcare plans or human resource trends.

Truth be told? PEOs can help retain jobs and increase profitability.

Employers outsource to PEOs to administer everything from payroll and payroll-related taxes to providing healthcare benefits, retirement planning and recruiting services.

That’s a lot of paperwork lifted off the shoulders and minds of company executives.

According to the U.S. Small Business Administration, as cited by the National Association of Professional Employer Organizations (NAPEO), the number of labor laws and regulations grew by almost two-thirds between 1980 and 2000. That translates into company owners spending a quarter of their time on employment-related paperwork.

The average PEO client has 19 worksite employees, according NAPEO. Without the PEO relationship, those employees would not be protected under the Consolidated Omnibus Budget Reconciliation Act (COBRA) or the Age Discrimination in Employment Act (ADA).

All those acronyms giving you a headache? Here’s one more: PPACA, which stands for Patient Protection and Affordable Care Act, better known as healthcare reform. A 2010 study by the Society for Human Resource Management (SHRM) showed 34 percent of organizations surveyed will not conduct an analysis to determine the impact of the healthcare reform law on their health plans. What will those organizations face as the provisions go into full effect?

That’s where a PEO comes in: It removes the guesswork and manages the most cost-effective plan while staying up to date on the latest healthcare-related laws.

Other ways a PEO serves as a partner include:

• Improved Benefit Package. According to NAPEO, 40 percent of companies upgrade their benefit packages by using a PEO. That is critical because the Small Business Administration estimates workers at small businesses with access to 401(k) has dropped from 28 percent to 19 percent, according to NAPEO. The flip side? An estimated 95 percent of workers in a PEO-provided arrangement have access to a retirement plan.
• Better Workplaces. PEOs focus on workplace risk management, safety programs and solid human resources practices. That makes for a safe, efficient workplace, because PEOs manage workers’ compensation coverage and claims.
• PEO long-term retention. PEOs that belong to NAPEO retain 86 percent of clients for a year or more, leading to consistent service that frees up time for business.

That last point is particularly important because employee satisfaction is key.

Another 2010 survey of executives by SHRM found the two biggest challenges in Human Resources for the next ten years will be (1) retaining and rewarding the best people; and (2) attracting the best people to an organization.

How will those challenges be met? Fifty-eight percent of executives surveyed said through providing flexibility to balance life and work – making it the top concern.

An effective PEO – a true partner, not the enemy – can help small- and medium-sized employers administer a cost efficient integrated human resource solution.

Doing so frees a company to focus on employee satisfaction and pursue revenue-generating activities – crucial in this economy that continues to tread water.

Let’s consider why the industry has been around for over 25 years, as an industry we have roughly 3% of what’s considered its potential market.

This is really a puzzling question for anyone as passionate about the PEO Industry as I am, why… why… why aren’t more businesses taking advantage of the PEO service model.  My belief is that there isn’t a small to medium business that couldn’t benefit from the services of a quality PEO.

So what’s missing?

What can we do?

I have some ideas as to what we can do, and I’m sure you may too.
 
Let’s spend the next few weeks getting opinions and ideas on why the industry doesn’t have a larger market share than it does.

And then let’s brainstorms ideas as to what we can do as an industry to help accomplish the goal.

Over the next year, let’s highlight and tell success stories of those PEO’s and PEO Industry Professionals who go the extra mile to promote the industry.

I hope nobody takes this wrong, but I don’t have many PEO brokers I would refer to anyone.  I’ve been in this business since the early 90’s and just haven’t had any good experiences with PEO brokers and the PEO Broker model (other than with Bruce from Employers-RX).  One really bad experience with a PEO broker that’s located just outside of Atlanta, a few years back I referred a couple hundred prospects to his organization… and he never closed one piece of business.  I’m not that naive to believe they didn’t close any of that business, I just feel I was taken advantage of and its left a pretty sour take of the entire segment of the business. 

I’d like to hear from some other PEO brokers who have a great story to tell, maybe get a reference or two from some clients who have a PEO broker they want to refer and hopefully I can end out 2010 with more than one PEO Broker to refer.

Changing my oil | PEO Blog

Don’t get it?  Yep, they simply don’t understand the concept.  I’m not pointing the finger, as an industry we don’t always send a clear message of our services, and the services can differ greatly from PEO to PEO.  Most of the value a PEO brings to a business is intangible; sure access to healthcare options, workers compensation, are nice, but it’s the intangible side of the service that offers the real value.

Quite often when you explain the concept to people they look at you with their eyes glazed over, kind of that deer in the headlights look.  They may tell you they understand it, but often they say that because they are so confused they just give up. 

So occasionally I’ll use my “Changing my oil” story….  Sure I know how to change the oil in my car, just like most business owners know how to handle employment stuff.  But I’ve come to the understanding that changing the oil in my own car isn’t the best use of my time.  The perception that I could save a few dollars by doing it by myself is quickly overcome by the reality that my time may have some value.  And the cleanup what a nightmare and what do I do with the used oil…

The story can be modified… making my own donuts, printing my own business cards, doing my own websites, etc.  Do what you do best, outsource the rest.

So what’s the magic to Holland Michigan?  The news clip touches on some of it, family, and religion, caring and sharing.
 
So what’s missing from the equation… it’s a belief that anything is possible, that it’s better to focus on the positive than the negative, that helping others helps us.

Sounds simple doesn’t it.  Let’s all vow to live 2010 with this belief, stop listening to the press and start taking control of our destiny.  Only you can make a change in your life, your business… this county still is the best place in the world to live, it offers unlimited opportunities, we just need to make things happen.

I live in one of the Happiest Towns in the USA, I guess before anyone else does, I’d like to claim the 2010 spot for the Happiest PEO in the USA!

But what about the hundreds of other PEO’s that exist, why isn’t anyone pushing out press releases about what they do for their clients.  I know it’s easy to get wrapped up in day to day stuff, but folks, if we all want the industry to grow; we need to talk about it. 

So for kicks, let’s just say there are 500 PEO’s nationwide, if everyone of those PEO’s send out one press release a month that would be 6000 press releases a year, that’s 500 a month, over 16 a day. 

I’ve been around this industry since 1991; I know the magic a quality PEO can bring to a business.  I’ve seen time and time again where PEO’s set business owners free from the minutia of employment.  Everyone that’s part of this industry can tell a story, it’s time to start.

Talk about your clients, what you’ve done to improve benefits or services to the worksite employee’s.  I don’t care what you talk about, just talk about your PEO and what it does for your clients and employee’s.

I am challenging every PEO to get moving, and start talking about the industry.  You want this industry to grow; we all are part of what it will take for PEO’s to win in 2010.
